PAGSISIGURADO NG MALAYA, NAUUNA, AT MAALAM NA KAPAHINTULUTAN

April, 13, 2021, the NCIP Bataan Staff together with IP Representatives, Rosita Sison, Dancel Payang, and Ana Monton with other community members had a dialogue with NIA re the on-going project PAMBAT-2020-SIP-BERNABE CIP-40 or the Canalization, Acess Road & Canal Structure that is now in Phase III located within the Ancestral Domain of Ayta Magbukun ICC in Brgy. Dangcol, City of Balanga, Bataan without Free, Prior and Informed Consent (FPIC). It was reported during the meeting that NIA received a certification from Brgy. Dangcol Captain that there are no Indigenous Peoples in the area that is why they proceed to project implementation without IP’s consent.
The Tribal Chieftain of Brgy. Dangcol, Ana G. Monton filed a complaint to NCIP re the on-going project inside their AD. NCIP called the attention of NIA-Dinalupihan then conducted an ocular inspection to validate the complaint. Based on the ocular inspection, the project is within the ancestral domain.
Since the principle of FPIC recognizes IPs’ inherent and prior rights to their lands, territories, and resources and respects their legitimate authority, and requires processes that allow and support meaningful choices by indigenous peoples about their development path, it was agreed that NIA will file an application for Certificate of Precondition to NCIP pursuant to the implementation of RA 8371 and NCIP Guidelines on the FPIC process and will have close coordination with NCIP. After the Work Order will be issued to the FPIC Team of Bataan, another meeting with the community and NIA will be conducted. This is to ensure IPs’ exercise of their right to self-determination with respect to developments affecting them.
